  • 70 miles per hour on freeways that have been designated for that speed;
  • 65 miles per hour on other freeways and highways that are not marked for 70 miles per hour;
  • 55 miles per hour on two-lane, undivided highways (unless the highway has been marked for a higher speed).

If the driver fails to abide by these absolute speed limits, then the driver is automatically considered as a speeding driver and has therefore violated the law.

Furthermore, Vehicle Code 22362 makes it illegal to speed while driving through a construction zone. Finally, California imposes a DUI "sentencing enhancement" if a driver is found to be under the influence of drugs or alcohol while speeding. The enhancement adds a minimum of 60 days in jail in addition to the driver's DUI sentence if it can be demonstrated that the driver drove 20 to 30 miles per hour over the speed limit and drove recklessly.
